1. Acceptance of Terms
By accessing or using wya (“the Service”), operated by Default World LLC (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
wya is a team availability application that helps organizations see who has upcoming out-of-office (OOO) and working-from (WF) time. The Service integrates with Google Workspace calendars via domain-wide delegation to display calendar events for team members within your organization.
3. Eligibility
You must be at least 13 years of age to use the Service. By using wya, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
4. Account Registration
To use the Service, you must sign in with your Google Workspace account. You are responsible for maintaining the security of your Google account and for all activities that occur through your use of the Service.
5. User Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Harass, stalk, or harm other users
- Impersonate any person or entity or misrepresent your affiliation
- Interfere with or disrupt the Service or servers connected to the Service
- Attempt to gain unauthorized access to any portion of the Service
- Use automated means to access or collect data from the Service
- Upload or transmit viruses, malware, or other malicious code
6. Calendar Data and Privacy
The Service displays calendar events (such as OOO and working location) that you and your team members create in Google Calendar. This information is visible to members of your Google Workspace organization. You are responsible for the content of your own calendar events. We encourage you to consider what information you include in calendar events that will be visible to your team.
7. Third-Party Integrations
The Service may integrate with third-party services such as Google Calendar. Your use of such integrations is subject to the terms and privacy policies of those third parties. We are not responsible for the practices of third-party services.
8. Intellectual Property
The Service and its original content, features, and functionality are owned by Default World LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEFAULT WORLD LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify, defend, and hold harmless Default World LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another.
12. Termination
We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason. You may terminate your account at any time by contacting us.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in New York, New York.
